1. Beta services
1.1 Definition
Cobbai may, at its sole discretion, make features, products, or services available to Customer on a trial, beta test, early adoption, pre-release or other experimental basis (collectively, “Beta Services”).
1.2 No support
Unless otherwise agreed to by Cobbai, Cobbai is not obligated to provide Customer with any maintenance, technical or other support for the Beta Services. If, at Cobbai’s option, such support is provided, Customer agrees to abide by any support rules and policies that Cobbai provides.
1.3 No guarantee of general release
Cobbai reserves the right to add or remove any features or functionality of the Beta Services. Customer agrees that Cobbai has no obligation to make available a general commercial version of the Beta Services. Should a general commercial version be made available, it may have features or functionality that are different from those found in the Beta Services. Access to the Beta Services does not guarantee Customer any discounts or preferential pricing upon commercial release.
1.4 Restrictions
Cobbai’s direct competitors are prohibited from accessing the Beta Services, except with Cobbai’s prior written consent. In addition, the Beta Services may not be accessed for purposes of monitoring their availability, performance or functionality, or for any other benchmarking or competitive purposes.
1.5 Disclaimer
Customer agrees that Cobbai has no obligation to make availabCustomer agrees that the Beta Services are being provided as “early access” features that are not ready for general commercial release and these features may contain bugs, errors, or defects. The Beta Services also rely on third-party large language models (LLMs). Accordingly, the Beta Services are provided “as is.” Cobbai and our affiliates and licensors make no representations or warranties, or conditions of any kind, whether express, implied, statutory, or otherwise, regarding the Beta Services, including any warranty or condition that the Beta Services will become generally available, be uninterrupted, error-free, or free of harmful components, or that any content, including Customer Data, will be secure or not otherwise lost or damaged. In particular, Cobbai does not guarantee that any content generated by the features will be accurate and/or free from offensive or unauthorized content. It is Customer’s sole responsibility to monitor the content generated by the Beta Services and Cobbai disclaims any and all liability related to Customer’s use of the Beta Services Cobbai may discontinue access to the Beta Services at any time or for any reason.le a general commercial version of the Beta Services. Should a general commercial version be made available, it may have features or functionality that are different from those found in the Beta Services. Access to the Beta Services does not guarantee Customer any discounts or preferential pricing upon commercial release.
2. Generative AI
The Services may contain generative artificial intelligence features that rely on internal or third-party large language models (“Generative AI”), including to generate Customer Content. To the extent Customer utilizes any Generative AI features, Customer acknowledges and agrees that: (a) there is no guarantee that Customer Content generated will be unique to Customer, accurate, non-infringing, or free of offensive or unauthorized content, (b) Generative AI features should not be relied upon for medical, legal, financial, or other professional advice; and (c) Customer is solely responsible for its use of the Generative AI features, including use in compliance with applicable laws. Cobbai shall have no liability for any Customer Content generated by Generative AI features or Customer’s use of the Generative AI features.
Customer can connect AI tools to link AI Agents to any back offices of external APIs. AI agents can call tools to retrieve external informations or perform actions. Cobbai shall have no liability for any Tool activation triggered by Generative AI features.
3. Multimodal Generative AI Features (Images and Documents)
3.1 Definition
The Services may include multimodal Generative AI features that allow AI agents to receive and process non-textual inputs, including but not limited to images, PDFs, or other document formats (“Multimodal Features”).For the avoidance of doubt, the Multimodal Features constitute Generative AI features as described in Section 2 (Generative AI) of these Service Specific Terms, and are subject to all limitations, disclaimers, and exclusions of liability set forth therein.
3.2 No Anonymization or Data Sanitization
Customer acknowledges and agrees that any data, including images, PDFs, or documents, submitted through the Multimodal Features will not be anonymized, redacted, masked, or otherwise sanitized by Cobbai. Cobbai does not implement any automated or manual process to remove personal data, sensitive data, or confidential information from such inputs.
3.3 Customer and End-User Notice Obligations
Customer is solely responsible for:
- informing its end users that data submitted through the Multimodal Features will not be anonymized or sanitized,
- obtaining any required consents, authorizations, or notices under applicable data protection and privacy laws,
- ensuring that end users are made aware of and accept the risks associated with submitting personal, sensitive, or confidential data.
3.4 Risk Allocation and Customer Responsibility
Customer acknowledges that use of the Multimodal Features is entirely at Customer’s own risk, and that Cobbai acts solely in accordance with Customer’s instructions. Customer remains solely responsible for:
- compliance with all applicable laws, including data protection, privacy, and confidentiality obligations,
- the nature, accuracy, legality, and appropriateness of all data submitted,
- implementing appropriate technical and organizational measures governing use of the Multimodal Features.
3.5 No Liability
Without limiting Section 2 (Generative AI) and to the maximum extent permitted by applicable law, Cobbai shall have no liability or responsibility whatsoever arising from or related to:
- the absence of anonymization or sanitization of data submitted through the Multimodal Features,
- any personal, sensitive, or confidential data submitted by Customer or its end users,
- any outputs generated using such data,
- any decisions, actions, or omissions taken by Customer or third parties based on such outputs
3.6 Prohibited and High Risk uses
In addition to the restrictions set forth in Section 2 (Generative AI), Customer agrees not to use the Multimodal Features for medical, legal, financial, regulatory, biometric, or other high-risk or regulated purposes. Cobbai expressly disclaims any liability arising from such use.
4. Updates
Cobbai may update or modify these Service Specific Terms from time to time. Customer’s continued use of the Services constitutes Customer’s acceptance of the updated or modified Service Specific Terms.
